Divorce Income Tax Question

Divorce Income Tax Question

I'm in the process of getting divorce. My separation date May 13, 2022. But we were living together until august 25, 2022.

I had been the only provider to the family for those months that we were living together.

Can I still be claiming her and our two kids as dependents? What will it happen if somebody else claims them?

Dependents During Divorce
by: BB

n the given situation, claiming dependents can be complex, especially during a divorce. The IRS considers the custodial parent, and if both parents claim the same dependents, it could lead to complications. It's crucial to follow the guidelines and discuss the situation with your divorce attorney or tax professional to ensure accurate and legal handling of dependents.

Divorce/ Retirement Plan

I got a divorce this year and had to give my ex-half of my profit sharing (retirement)account. I was told by some people here they wrote of this amount. Just wanted to ask someone who may know. Is this ok to do? If so how or where do you go about this on tax forms?
Thanks

In the given situation, dividing a retirement account during a divorce typically involves a Qualified Domestic Relations Order (QDRO). While the distribution might not incur the usual early withdrawal penalties, it's essential to follow proper procedures. Consult with a tax professional or financial advisor to ensure accurate reporting on your tax forms.

Will Divorce Decree Have Precedence

by Kim
(Baldwyn, MS)

In my divorce decree it is stated that I would get to claim my child as dependent on taxes. I moved to a different town last April, and as a result my child spends most of her time now with her dad because she doesnt want to change school systems.

One of the IRS questions on my return asks if dependent spent more than 6 months with me. Does the judges' decision in my divorce decree have precedence, even though my child was not with me more than 6 months?
