Can I File HOH Income Tax Question

My husband and I have been living apart for 7 months, we have 3 children and have agreed on everything without having to get a mentor involved. We have continued to share the same checking acct b/c we figured it was easier since we have so much together.

Can I claim Head of house hold even though I'm still married? We live in Florida and legal separation is not recognized here and we haven't yet made the decision on divorce.

I believe whether or not she would be able to claim you and file taxes as head of household will be dependent upon if she paid over half of your support.

As per the IRS:

Head of Household - Generally, you may claim head of household filing status on your tax return only if you are unmarried and pay more than 50% of the costs of keeping up a home for yourself and your dependent(s) or other qualifying individuals.

Keeping Up a Home

To qualify for head of household status, you must pay more than half of the cost of keeping up a home for the year. You can determine whether you paid more than half of the cost of keeping up a home by using the following worksheet.

Cost of Keeping Up a Home

Amount You Paid vs. Total Cost

Property taxes
Mortgage interest expense
Rent
Utility charges
Repairs/maintenance
Property insurance
Food consumed
on the premises
Other household expenses
Totals

Minus total amount you paid

Amount others paid

If the total amount you paid is more than the amount others paid, you meet the requirement of paying more than half the cost of keeping up the home.

Costs you include. Include in the cost of upkeep expenses such as rent, mortgage interest, real estate taxes, insurance on the home, repairs, utilities, and food eaten in the home.

If you used payments you received under Temporary Assistance for Needy Families (TANF) or other public assistance programs to pay part of the cost of keeping up your home, you cannot count them as money you paid. However, you must include them in the total cost of keeping up your home to figure if you paid over half the cost.

Costs you do not include. Do not include in the cost of upkeep expenses such as clothing, education, medical treatment, vacations, life insurance, or transportation. Also, do not include the rental value of a home you own or the value of your services or those of a member of your household.

My husband filed as head of household as we just recently married and this was what he did before he met me. However, I believe this was a mistake. I have not filed yet, but can we fix his filed taxes? How do we go about doing that?

If my qualifying child gets married in late july, can I still claim the head of household for my taxes as i did provide 100% of the living expenses for more than 1/2 of the year. Will she be able to file as "married" also? Her income was less than $5000.00

To Qualify for Head of Household

To qualify for Head of Household status, you must meet specific criteria. Firstly, you must be considered unmarried for tax purposes, which means you cannot be legally married by the end of the tax year.

I am a renter, and live with a boyfriend who gets social security disability. He is not able to work, and therefore doesn't file taxes. He can't be claimed on anyone else's return. Can I file as head of household since I pay over 1/2 of the living expenses, etc?

Head Of Household Caring For Brother

My 65 year old brother is unable to work and lives with me. He brings in $776 a month in social security, receives $125 a month in food stamps and dips into a modest annuity to take out $5000 a year. We bought this house last year jointly.

Can I claim head of household, since I work full time and pay most of the bills? Will this affect his ability to get assistance? Does it make a difference that his name is also on the mortgage?

I think you can only claim one or the other, either Head of Household or Married Filing Joint.

You claim Head of Household status when you are not married or are separated and have a dependent child.

Otherwise, if you have a husband, you will already be getting an exemption for him by filing as Married Filing Jointly.

Head of Household Rules

I have a child who turned 24 in April 2011; however, I provided his home and paid for most of his upkeep. I know I cannot count him as a dependent but can I file as Single/Head of Household?

He is a former college student but stayed out in 2011 due to lack of funds to finish his degree.

Head of Household Status

My husband had to accept a disability retirement last year. He is only 53, but glaucoma has now prevented him from keeping his job and driving. He collects a disability pension from the State of CT. I work full time and part time. We have a 16 year old daughter. Can I now file as head of household and will this aid us in our taxes if we do file this way? Our approximate combined income will be about $80000 this year, about 25,000 less than last year.

Head of Houshold Tax Rules

I have a question about rule #2 below...

You may be able to file as head of household if you meet all the following requirements.
1. You are unmarried or “considered unmarried” on the last day of the year.
2. You paid more than half the cost of keeping up a home for the year.
3. A “qualifying person” lived with you in the home for more than half the year (except for temporary absences, such as school). However, if the “qualifying person” is your dependent parent, he or she does not have to live with you. See Special rule for parent , later, under Qualifying Person.

Does the person have to make 1/2 of the money themselves from a job or does Child Support and Spousal Maintenance count as income for this rule?

Providing Over Half The Cost

Hi,

How to determine if support test is met. You figure whether you have provided more than half of a person't total support by comparing the amount you contributed to that person't support with the entire amount of support that person received from all sources. This includes support the person provided from his or her own funds. You may find Worksheet 3-1 in IRS Publication 17 helpful. Child support or spousal support is typically money given to you that you then use to provide support.
