Yes, you should be able to claim the purchase of the backhoe on your income taxes. You can do this by amending your return in the year of purchase and adding it on as a Section 179 depreciation deduction against your farming income.

My father passed away in March and had not filed his 2010 taxes. He was self employed, kept virtually no records of anything, and was on the verge of bankruptcy at the time.

The only documentation I have is his bank account records. I am not the executor or court appointed representative of his estate, but have been handling his affairs and dealing with the few assets he does have.

I have claimed some of his property (bank accounts, two old junker cars), so have some liability for his taxes. How can I go about filing an accurate return?

Do I File Form 8283 and Which Parts?

I have noncash charitable donations of clothing/toys/household items, etc. of over $5000 for 2009. Most of the donations (all made on separate days) are under $500 for each but two totals are around $600 each. Since all of these donations are similar items (bags of clothing and the like to Goodwill, etc.) and the grand total is over $5000 for the tax year, do I need to file a separate 8283 for each donee? Do I have to fill out Section B for each donee or can I skip that section? I have no appraisals. Each donation consisted of several bags of clothing and such and while the yearly grand total is large, no one item is. There were no over $500 single items. I am stumped on what to do. I read the instructions to the form and it's as clear as mud. My H&R Block software is not cutting it. It tells me there might be an error but doesn't tell me what to do. Thanks for any help!

Thank you for your question.

You will indeed need to list each individual donation as separate line items on form 8283. Anytime non cash charitable donations total over $500 (after adding them all together), you will need to fill out form 8283 and list each donation separately.

Do I Need To file?

Hi! I can't figure out if I need to file taxes. I'm only 20 so I'm new to this. I was an independent contractor for a company and made $5300 before they let me go for being in the hospital.

I saved all my receipts (gas for example - the co. was 65 miles away from me). I didn't have a chance to set any money aside as I wasn't working there long enough. Can I set up a payment plan with the IRS or file an extension? And do I even have to file? If I do, what expenses can i write off?

I have some queries regarding e-filling.

First Question:

Is the Digital signature mandatory as the message falshing on your website https://incometaxindiaefiling.gov.in/portal/howToEFile.do ?

"e-Filing for AY 2011-12 has been started (ITR-1(SAHAJ) and ITR-2 are now enabled). Digital Signature Certificate made mandatory w.e.f 1st July 2011 for Firms and Individuals whose accounts are required to be audited u/s 44 AB of the Income Tax Act' 1961. Click here to download notification no. S.O. 1497(E) dtd 1st July 2011 in this regard."

I have also read the following on your website.

(2) Types of E-Filing
•There are three ways to file returns electronically.
•Option 1: Use digital signature, in which case no further action is required.
•Option 2: File without digital signature, in which case the duly signed ITR-V form is to be submitted to CPC Bengaluru using Ordinary Post or Speed Post within 120 days of transmitting the data electronically. This completes the Return filing process for non-digitally signed returns.

Second Question:

In case of e-filling ,what will be the proof with me that I have filled the return for the respective year.

For example ,What proof should I show to the manager when I go for a LOAN procedure or something like that.

If I filled with "without digital signature" option and post the acknowledgement print to nearest IT department,Will they send some hard copy to me again.

You can still file as Married Filing Jointly if your spouse agrees. This typically results in a lower tax liability and so would be best. Otherwise, you can file as Married Filing Separately.

Hello,

Typically you will want to file as Married Filing Jointly in order to receive the greatest tax benefits and filing as Married Filing Separately can cause you to lose tax credits. However, this is not always possible when two people are separating. So you actually have the option of filing as Married Filing Jointly if he will agree, or whoever has the children and is paying over half of the support can possibly file as Head of Household.

I have for the last 7 yrs been married, but last 6 filed HOH, and received EIC. I'm unmarried and single and live alone. My parents live abroad and I send them money from my income.

Could I file as head of household, as my tax returns are SIGNIFICANTLY different when I file as head of household vs filing as single. (owing 1000$ in single status vs getting back 300 in HOH status)

I dont have any dependants or any qualifying person living with me.

Im not a US citizen but am on H1B work visa and pass the 183+ days test, so I'm taxed like one.

Hello MJ,

Great question, thank you for asking.

You may be able to file as head of household if you meet all the following requirements.

1) You are unmarried or "considered unmarried" on the last day of the year.

2) You paid more than half the cost of keeping up a home for the year.

3) A "qualifying person" lived with you in the home for more than half the year (except for temporary absenses, such as school). However, if the "qualifying person" is your dependent parent, he or she does not have to live with you.

Special Rule for Parent:

If your qualifying person is your father or mother, you may be eligible to file as head of household even if you father or mother does not live with you. However, you must be able to claim an exemption for your father or mother. Also, you must pay more than half the cost of keeping up a home that was the main home for the entire year for your father or mother. You are keeping up a main home for your father or mother if you pay more than half the cost of keeping your parent in a rest home or home for the elderly.

Yes, you may be able to claim your sister as a dependent if she meets the qualifying criteria. However, her income should be considered when determining if she qualifies as a dependent. I havent worked for a "punch in job " all year, due to ssa telling me if I make to much income, she will lose her benefits. So I do private homecare on my own and that way im able to have her with me, or be close for her at all time.

Where do I start for my taxes this year? And how do I begin? I still have never received a 1099 for her ssa and I made a total of 1000.00 in the year. Please help me understand.

Married Filing Joint or Seperate

My wife and I divorced about 10 years ago then remarried about 3 years ago. I had very low self employment income during the whole peiod and did not file my taxes. My wife made a normal paycheck but filed as single and head of household even after we were re-married. I recently started working on my back taxes. My question is should I call the IRS and say she made a mistake in her filing status or just start from here and file jointly or file seperate knowing I will owe some back taxes? Any help would be appreciated.

No Income Tax Filed

Hi, In 2007 I did not file an income tax return because I did not make any income although, I did attend a college program and have a deduction slip for this year. Would I benefit from now filing a return or having my husband refile his return ( which he has only recently done)?

Non Filed Taxes

I'm scared to contact the IRS that I have not filed taxes in overs 15 years. What should I do? I was a full and part-time student for 9 years out of the 15 years for not filing taxes. I'm scared what should I do and who should I contact besides the irs?

During the time that you were a student, if you did not have income, you did not need to file taxes. The same is true for the years that you were not a student, depending upon the amount of income you made.

If you worked for someone who provided you with a W2, the IRS should already have record of this and should have notified you regarding any taxes owed. If you have never been notified, then there is a chance that you had a sufficient amount of taxes withheld from your paychecks to cover any liability and may even be entitled to a refund, you never know!

You should go ahead and file your current year taxes as soon as possible so that you can start filing if required and not have to worry about the possibility of incurring any penalties and interest on any additional liability or to get any refund you may be entitled to.

Problem in Filling Figures in Online ITR 2 Form in Sheet, CG_OS & Schedule SI

I want to put figures for short term capital gain from Sell of shares. in Sheet, CG-OS, i've filled Fully value of Consideration, exp. on transfer, Cost of acqn.& arrived calculated figure of STCG. But in below of that sheet, i m not able to insert figures in Table, showing Quarterwise detais, eg. stcg up to 15/09, 15/12, 31/12 & 31/03. I m not able to validate theat sheet. & in sheet SI (ie. special income), i want to insert figure of short term capital gain taxable at 15 % in SI schedule. But thre also i m not able to insert any figure.

Wht can be the problem ? i want to know that.

If you are being paid as a W-2 employee, you will need to file a return if you made over $9,350 in 2010. Unless you have any additional deductions, you will need to pay taxes on $650.

You can fill out your W4 as exempt no matter what amount you make, but filing as exempt will make it so that you do not have any taxes withheld. Therefore, you will have to pay the taxes on the $650 on your tax return in addition to an underpayment penalty.

Single Member LLC Filing

I am the owner and only employee of a single member llc. I contract with several companies that issued me a 1099. Last year I paid myself as an employee and a contractor, from the reimbursement of the companies, in and attempt to reduce or eliminate having to pay quarterly taxes this year. Since I received 1099s from these companies, my company, and a w-2 from my company, how to I file and report my income? If I reported what the companies paid me and what I paid myself, wouldn't it appear as if I made more when I really didn't?

State Filings (2) for Part Year/Only Income CA UI Benefits

My only income for 2010 was UI Benefits from the state of California. I lived in CA for 10 months of 2010 and moved to AZ for the last 2 months. Do I need to file part year forms for both states? If so, will the state of Arizona expect me to pay state income tax on the CA UI benefits? I know I do not have to pay CA income tax on UI benefits. Please help!

To File or Not to File

I am considered a dependent on my Dad's taxes. I made $3200 dollars last year working over the summer. I also made $72.00 on a long term capital gain after a stock sale, as well as $42.00 from dividend payments on a stock. This total is less than $5700, so I technically do not have to file. However, my job withheld $222.52 for income taxes, so I want a refund. But when I do my 1040, the "qualified dividend and capital gain tax worksheet" says I owe $328 simply because of the dividend and the long term sale. If I had made 1000 bucks on short term sales I would be fine. This doesn't make since to me. Can I just write "0" instead of $328 since my total income is less than $5700? Or should I just forget about the refund and not file? I am certainly not going to pay more money to the IRS on such a small salary...

Hello,

Thanks for the inquiry.

You should go ahead and file. Based on the information you provided, you adjusted gross income would be 3314 (3200 + 72 + 42) and your 2010 standard deduction for your single filing status would be 3500 which means you would have no taxable income (3314 - 3500 = -186) and should get a full refund of the 222.52 that was withheld.

Two People Filing Dependents

I filed my taxes electronically and it said someone else claimed them. I belive it was their grandmother. she owes over 30,000 dollars for not paying taxes. she claimed them when she found out she owed. I want to know if this will have some signifigance on their decision of who gets to claim them. I have always claimed them for the past 13 years

Do I need to file 2009 income taxes if I only made $8,000.00 and I never received my W-2 forms from my ex-employer?

If you were single under the age of 65 and made less than $ 9,350 in W2 wages, you are not required to file. You may still wish to do so in order to get back any refund of taxes withheld.

Where To File Taxes When I Work In Two Different States?

I moved to AL an worked three and a half months. I moved back to KY and worked about 5 months here. Can I file in AL with both tax forms even though one is from AL an one is from Kentucky?

Wife Filed a False Return

married 14 yrs. married at end of 2010. always filed joint return.

Wife wants divorce. She grabbed all tax docs and refuses to give me access. We live in Nevada, a community property state.

Wife file Married, filing Separately. She used all of the community deductions. She did not follow any of the rules regarding community income or deductions. She has already gotten a refund.

I cannot file a valid return under these circumstances. if I file with what I have, I'll be filing a false return.

What do I do? she refuses to talk about it or anything else. Do I report her to the IRS? Do I file for an extension even though I won't owe anything?

I am at a loss. any help is appreciated.

Hi Br Ellis,

Thank you for your question regarding when to file an extension.

Even if you are due a refund, it is best to go ahead and file an extension in order to avoid the late filing fee.

However, you won't have to worry about incurring additonal penalties and interest since you are not expecting to owe anything.
