I received determination from the county and IRS. Because I pay an insurance premium for them to receive the foster care, the case is voluntary, the foster parents receive payment for their services, as well as a stipend for expenses, I'm still financially responsible for the kids (paying for med insurance, extras, etc....). I also pay > 50% of expenses. Therefore, I"m able to claim the kids.

Claiming foster children

You cannot claim your children while they remain in foster care. They would have had to reside with you. The state, or county where you live pay the foster parents enough money for all of your children's needs. if you feel that the foster parents are not sufficiently caring for them, you need to complain to the caseworker. Your contributions to the kids are considered gifts.
