I am 23 years old, I live at home with my parents, I am not a student. My pre tax income for this last year was $20,385, my fed witholding was $2,236. I was not a full-time student at any period in this last year. My parents want to claim me as a dependent, but I want to claim myself as a dependent. It is my understanding that because I am over the age of 19, and I was not a full-time student at any time during the year, my parents cannot legally claim me as a dependent and that I can claim myself as a dependent on my return. Is this correct?

Here's the situation:

I filed a tax return (Individual tax return 1040) and I claimed my mother, who lives with me and qualifies, as a dependant.

Now..


When I attmepted to file a individual tax return form using XXXX, The return was rejected stating that my mother's social secuirty number had already been included in a return ( MY 1040 form)?

Now.

My question is:

Can I file a 1040 return for my mother if I have her claimed as a dependant on my tax return?

Hi Amir,

This is a good question.

Yes, you can file a 1040 return for your mother if you have claimed her as a dependent. However, you will need to make sure to check the box that says that she has already been claimed as a dependent so that she will not get her exemption only her single filing status.

I have a brother who loves with me all in all I've paid 2650 of expenses for him and myself. He's gotten a total of 4200 for the year but only pays about 900 dollars for living expenses the rest I account for. He spends the rest of his money on leisurely items such as music phone and video games (being a teenager) would he qualify to be a depandant relative of mine. No he can not claim you. The simple fact is, you made more than $3650 which is the earning limit. Once you earn that or more you can not be claimed as a dependent.

No, you generally cannot claim your spouse as a dependent on your tax return as you would be filing as Married Filing Jointly.

Filing as Married Filing Jointly already gives you a tax exemption so you can't "double dip".

My adult son has lived with me for the past year due to being unemployeed. He had been self-employeed but lost his lawn care business in the economic downfall. He owes business taxes and a lien has been placed on the business (it is no longer in existance). If I claim him as a dependent on my taxes, does that make me responsible for his past due taxes? will they take what is due out of my refund? I was not on his business.

If you claim someone on your taxes as a dependent who owes past due taxes, this would not make you liable for what they themselves owe. You should still be able to get your full refund.

My mom has lived with us for the last 3 years, I have never claimed her as a dependent but think I can and would like to amend my returns. We do not charge her anything to live here. We contribute to her food, but she does buy some of her own food. She does pay for her own medicine and her own fun. She has savings accounts but does not touch them. Thanks,

If your mom has lived with you for the last 3 years, and you have never claimed her as a dependent you should be able to amend your returns.

If you do not charge her anything to live there and contribute over half of her support, as long as she earns less than 3,650 (for year 2010) she may be considered as your qualifying relative.

W4 Exemptions

Yes you can claim 0 or 1 exemptions for withholdings even though there are four of you. The W4 is just a guideline to help you determine how much taxes you will need to withhold but you can withhold more than recommended for just in case if you would like.

And you can also claim married filing at the single higher rate during the year instead of married.

I have heard where people claim 8 dependents during the year, then claim their actual number of dependents at the end of the year ( say 2 dependents ). Is this legal? Can't they get into trouble doing this?

Thank you for your dependent question. It sounds like you are referring to the number of exemptions that people claim when filling out their form W4 for tax withholdings from their paychecks.

A person is allowed to claim more dependent exemptions on their W4 and then claim the correct amount on their tax return. The amount claimed on the W4 is simply an indicator of the amount of taxes they would like to have withheld from each paycheck.

The term "dependent" means:

1) A qualifying child, or
2) A qualifying relative

You can claim an exemption for a qualifying child or relative only if these three tests are met.

1) Dependent taxpayer test
2) Joint return test
3) Citizen or resident test

An overview of the rules for claiming an exemption for a dependent are:

1) You cannot claim any dependents if you could be claimed as a dependent by another taxpayer.
2) You cannot claim a married person who files a joint return as a dependent unless that joint return is only a claim for refund and there would be no tax liability for either spouce on separate returns.
3) You cannot claim a person as a dependent unless that person is a U.S. citizen, U.S. resident alien, U.S. national, or a resident of Canada or Mexico.
4) You cannot claim a person as a dependent unless that person is your qualifying child or qualifying relative

The test to be a qualifying relative are:

1) The person cannot be your qualifying child or the qualifying child of any other taxpayer.
2) The person either (a) must be related to you in one of the ways listed under relatives who do not have to live with you, or (b) must live with you all year as a member of your household.
3) The person's gross income for the year must be less than $3,650 (for 2010)
4) You must provide more than half of the person's total support for the year.

A relative who does not have to live with you is a person related to you in any of the following ways:

1) Your child, stepchild, foster child, or a descendant of any of them (for example, your grandchild). (A legally adopted child is considered your child.)
2) Your brother, sister, half brother, half sister, stepbrother, or stepsister.

So, in summary it sounds like you should be able to claim the dependency exemption.
